1. The agreement
These terms are an agreement between you and Kunal Dholiya, an individual based in India, who operates send0 ("send0", "we", "us"). They cover this website, the waitlist, and the hosted send0 service ("send0 Cloud"), including its API, SDKs, MCP server and dashboard. Our Acceptable Use Policy and Privacy Policy are part of these terms.
If you use send0 for a company, you confirm you have authority to accept these terms for it, and "you" means that company. You must be at least 18 years old.
2. The open-source software
The send0 server is licensed under the GNU Affero General Public License v3.0, and the SDKs and MCP server under the MIT License. Those licenses, not these terms, govern your use of the source code and any instance you host yourself.
3. Pre-release service
send0 Cloud is in development. Joining the waitlist doesn't guarantee access. During the beta, features, limits and the API may change, the service may be interrupted, and we may need to reset data. Don't rely on the beta as the only copy of mail you can't afford to lose. We'll give reasonable notice before breaking changes where we can.
4. Your account
- Sign up with an email address you control, use a strong password that you keep to yourself, and keep your account details accurate.
- Keep API keys secret. You're responsible for everything done with your keys and by agents acting for you.
- Tell us right away at security@send0.dev if you suspect unauthorised access.
- One person or company per free account. Don't create extra accounts to get around limits.
5. Using send0 responsibly
You must follow the Acceptable Use Policy and all laws that apply to the mail you send and receive, including anti-spam, privacy and consumer-protection laws. You are the sender of mail sent from your inboxes, and you're responsible for its content and for having the right to send it. We apply sending limits, suppression and automatic pauses to protect deliverability, and we may change them as needed.
6. Your content
You own the messages, attachments and data you send, receive or store with send0 ("your content"). You grant us a limited permission to host, process, transmit and display your content only as needed to provide, secure and support the service. We don't sell your content or use it to train AI models. When you delete an inbox or your account, we delete its content as described in the Privacy Policy.
7. send0.email addresses
Addresses on send0.email and our other shared domains are provided for use with the service. They remain ours. If an inbox is deleted, or your account is closed or suspended, the address may stop working. We don't reassign a deleted address to someone else for at least 12 months. For an address you control permanently, use your own domain.
8. Fees
Joining the waitlist is free, and so is the beta unless we tell you otherwise in advance. Before paid plans start, we'll publish prices and plan limits. You'll only be charged after you choose a paid plan. Taxes are added where the law requires.
9. Suspension and termination
You can stop using send0 and delete your account at any time. We may suspend or close an account, an inbox or a key if it breaks these terms or the Acceptable Use Policy, puts other customers or the service at risk, or if the law requires it. Where it's safe and lawful, we'll tell you why and give you a chance to fix the problem or export your data first.
10. Disclaimer
send0 is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, including that the service will be uninterrupted or error-free, that every message will be delivered or land in an inbox, or that spam, authentication and prompt-injection checks will catch every problem. Email delivery depends on systems we don't control.
11. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to send0 is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that can't be limited under law.
12. Indemnity
If a third party makes a claim against us because of your content, mail sent from your account, or your breach of these terms or the law, you'll cover the reasonable costs and damages that result.
13. Changes to these terms
We may update these terms. We'll post the new version here with a new date and, for material changes, email account owners at least 14 days before they take effect. If you keep using send0 after that, the new terms apply.
14. Governing law
These terms are governed by the laws of India. Courts in India have exclusive jurisdiction over any dispute arising from them, unless the law where you live gives you the right to bring a claim locally.
